Euthanasia (in terms of some European countries - comparison)

Résumé Euthanasia is and always will be a hot topic of very heated debate among both non specialists and experts. The purpose of my thesis is to provide the reader with information about euthanasia and a list of rules dealing with the issue of euthanasia in selected countries. The introduction outlines the problems of euthanasia. The second chapter is devoted to clarifying the content of the notion of euthanasia, which comes from the Greek word for the phrase, "eu" meaning good and "thanatos" meaning death, a "good death", sometimes we can also meet the looser translation of euthanasia as a beautiful death. The content of the notion of euthanasia in the course of history changed. Today we see euthanasia as an act which one person intentionally ends the life of another person's own request with the intent to end her suffering. In the chapter are identified and defined forms of euthanasia, especially active and passive. The third chapter deals with the European Union's attitude to euthanasia. No law of the European Union explicitly addressed the euthanasia. Health policy in principle falls within the competence of national governments. Euthanasia was and still is one of the most controversial topics. It is a complex problem that involves religious, moral, medical and legal aspects. My thesis is focused on euthanasia in relation to the law. The aim of the thesis is to analyse the issue of euthanasia from the perspective of legislation in the Czech Republic. The thesis consists of five chapters. The first chapter contains introduction to the topic of euthanasia. The second chapter is devoted to the definition of term euthanasia. Euthanasia is a word of Greek origin ("eu"- good and "thanatos"- death). Its meaning is good, beautiful or merciful death. Nowadays the term is used in the sense of intentionally termination of life on request to relieve pain and suffering. This chapter also includes the definition of forms of euthanasia. The third chapter is focused on euthanasia in the sense of killing on request. In this meaning, euthanasia has never been explicitly regulated in the Czech Republic. But it does not mean that the issue of legislation of euthanasia is not actual. This chapter is subdivided into the three parts. The first part is about history of legislation of euthanasia. Euthanasia is nowadays hot topic not only in terms of societal impact but also in terms of criminal law. This work is devoted to the introduction of the concept of euthanasia, its history and various forms of euthanasia. There is also a view of supranational institutions and organizations to euthanasia. A substantial part of the work is devoted to euthanasia legislation in selected European countries and their analysis. Attention is also focused on the criminal aspect of euthanasia in these countries. One of the final chapters looks back on medially well-known cases, which stirred up a debate on euthanasia. Euthanasia represents one of the most controversial topics around the world. As I mentioned in the first chapter there is no worldwide consistency whether to accept the idea of legalization Active Voluntary Euthanasia ("AVE") or not. The goal of this diploma thesis is not to persuade anybody. In approximately 60 pages of the text I am providing readers with some essential information about euthanasia in the Czech Republic. I am also trying to compare the foreign legal regulation of euthanasia and assisted suicide but theoretical ideas as well. The first chapter is mainly trying to capture the reader's focus and setting the theme of my diploma thesis. The second chapter of my thesis is called ,,The Term Euthanasia". This chapter provides readers with several definitions of euthanasia and Physician Assisted Suicide ("PAS") as well as some historic data. The act of euthanasia has its origin in Greek. First word euthanasia is mentioned in old Greek literature. The term euthanasia is composed from two Greek words. Eu which means good or normal and Thanatos which means death. Euthanasia and the Criminal Law

The goal of this thesis is to point out the weaknesses of the current terminology of euthanasia and get a closer look on the role of the euthanasia in the Czech legal system with the main focus on criminal law. The secondary goal is to evaluate de lege ferenda legislation. To address this issue comparison of Czech and foreign legislation was included. The analysis leads to conclusion that the term euthanasia needs to be correctly defined to be usable in academic discussion. The definition needs to include differentiation from other conducts that are called euthanasia by the general public even though they cannot be classified as euthanasia by law. The main conclusion of the thesis is that legislation of euthanasia is not a right way forward in the Czech Republic. Nevertheless the Czech legislation should include criminal act of "killing upon request". Alternative to euthanasia should be improvement of palliative care and application of the institute of living will in practice. All future solutions of this controversial issue have to be based on comprehensive and diverse discussion amongst both the public and the legal experts.

In this thesis, I examined the definition of euthanasia and its different forms, as well as the legal evolution of this term and its constitutional foundations in the Czech Republic. Furthermore, I focused on the legislative treatment of euthanasia in the Czech criminal law, and compared it to the legislative treatment of euthanasia in Australia, Colombia, and England. In every individual state, I tried to capture the most important moments concerning the legal regulation of euthanasia and assisted suicide. In Australia, I focused mainly on the very first legal regulation of euthanasia, in Colombia, progression of an application of the Constitutional Court judgment on active euthanasia and in England, the evolution of relevant case law, usually related to assisted suicide. The most detailed explanation, of course, focuses on the Czech Republic. In my analysis, I used a variety of Czech and foreign legal sources, including modern sources such as video conferencing. By comparing the approaches, I provided a general overview of differentiation of euthanasia and its potential criminal impact. Langer's Drama Angels With Us and The Problem of Euthanasia

The purpose of this thesis is to analyze the play of František Langer Angels among us, which he wrote in 1931. Although it was written more than eighty years ago, it still expresses the very topical issues. One of the main themes of the play, which the author addresses is the problem of euthanasia, which has been debated since ancient Greece and Rome and cease debate even today. The paper includes a description of how to treat the theme in the play itself, what opinions on euthanasia prevailed in past centuries, when the play was written and attention is focused even on the present.

Right to live vs. unnatural termination of life

The aim of this thesis is to clarify the concept of the right to life in the legislative in the Czech Republic and in abroad with a comparison with its unnatural end, while abortion and euthanasia. This work is primarily devoted to law regulation of these institutes, but also covers other aspects such as religion, philosophy and science. It is designed so that each and every chapter is in its introductory section devoted to the formulation of the topic, the historical development in the Czech Republic but also abroad, it introduces the possible procedures and attitudes, it mentions for example and briefly compares similar institutes. Other parts of the diploma deal with legislation whether the right to life, abortion or euthanasia, provides comparison of domestic legislation with internationals. In light of the judgments of the European Court of Human Rights points the views and attitudes on the subject at the international level. The final section is then evaluated core issues especially from the standpoint of law.
